1.1.Aylo Freesites Ltd (hereinafter “we”, “us”, “our”), the operator of https://www.TrafficJunky.com (“Traffic Junky” or “TJ”), makes available, via application, request for access (whether by API or by any other method made available from time to time) to the TJ advertisement repository found at https://www.trafficjunky.com/ad-repository (or as may be from time to time) (hereinafter the “Ad Repository”), for advertisements previously or currently displayed on https://www.Pornhub.com (hereinafter “Pornhub”).
1.2. Before you are able to complete your registration for access to the Ad Repository (either via API or through the public access method), you must agree to the following terms and conditions, in their entirety.
Access via any method to, or otherwise use of any part or the whole of the Ad Repository service shall amount to your acceptance of these terms and conditions. If, at any point, you do not agree to the entirety of these terms and conditions, you must not register for and use any part of the Ad Repository.
If you are accessing the Ad Repository as a representative of an organization, you hereby warrant that you have the authority to bind such organization to these terms and conditions, in their entirety, and understand and accept that, by using any part of the Ad Repository, you are binding the organization you represent to the terms and conditions of the Ad Repository.
1.3. We may update these terms and conditions from time to time, the latest version of which will be reflected in the “Date Last Modified” date at the top. Though we may make reasonable efforts to notify you of any important changes, you are ultimately solely responsible for familiarizing yourself with these terms and conditions and any subsequent updates hereto.
1.4. These terms have been drafted and are provided in English. If these terms are translated into or are otherwise provided in any language other than English, it will be for information purposes only, and the English-language version will prevail in the event of any conflict between the English-language version and any translation of the same.
- Rules and Limitations of Use
2.1. To prevent spam or system overload, API-related access requests are limited to ten (10) API requests per minute. If you are unable to access the Ad Repository via API for this reason, kindly try again at a later time.
2.2. For API access to the Ad Repository, once you have validly completed the registration process form, you must request an API access token (hereinafter the “Token”) (and be granted the same) in order to access the Ad Repository. Each Token granted is valid for a period of six (6) months; once a Token expires you must re-apply for another Token in order to continue to have API access to the Ad Repository.
For the public access method to the Ad Repository, once you have validly completed the registration process form your request will be examined and, upon validation, a confirmation email to the email address you inserted in this form will be sent.
You may then login to access the Ad Repository using only the validated email address, upon which we will send you a second email to that address containing a one-time password.
You will require a new password each time/session you wish to access the Ad Repository for.
2.3. Access to the Ad Repository is offered pursuant to the provisions of Regulation (EU) 2022/2065 (the “Digital Services Act” or “DSA”) and is, therefore, only available to users within the European Union.
2.4. If we determine any advertisement previously displayed on Pornhub (and therefore normally available in the Ad Repository) to be illegal or otherwise infringing on applicable terms or regulations, we may, in our sole but reasonable discretion, remove from display in the search results of the Ad Repository the illicit or infringing advertisement.
2.5. In accordance with our obligations under the DSA, we shall make reasonable efforts to maintain the accuracy and completeness of the information provided in the Ad Repository but make no warranties to the same.
2.6. Pursuant to Art. 39 and 40 of DSA, you may access the information listed in the Ad Repository for your or your organization’s information only or, if you are a researcher, for research purposes only, specifically for the sole purpose of performing research that contributes to the detection, identification and understanding of systemic risks in the Union pursuant to Article 34(1) DSA (together the “Approved Purpose”), and any purpose or use other than the Approved Purpose is considered an infringement of these terms and conditions.
2.7.The ads displayed on Pornhub may belong to (including the intellectual property thereof) third-party advertisers. You understand and warrant that you will not use any part or the entirety thereof of the Ad Repository, or any information accessed to via the same, without prior permission from the owner of the same, or for any purpose not allowed by law.
Where an ad is displayed by a third party, the advertiser behind that advertisement is solely responsible for the same, and any statements, quotes, or views expressed via such ads do not necessarily reflect our views.
2.8. Any infringement of these terms and conditions (or of any other terms and conditions applicable to the Ad Repository, Traffic Junky, or Pornhub from time to time) shall lead to the immediate termination of your access to the same.
- Governing Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with the laws of the Republic of Cyprus. Any legal proceedings brought forward in connection with access to, or otherwise use of the Ad Repository, these terms and conditions, or of Traffic Junky in general, shall be brought forward in a court of competent jurisdiction in the Republic of Cyprus.
